- 5.2The winner will be determined by a single random draw conducted from all sold and validly issued tickets. The draw will be independently monitored by LDP Compliance Proprietary Limited as well as the NLC.
- 5.3The decision of the Club as to the identity of the winning ticket is final and binding, and no correspondence will be entered into, save as required by the Lotteries Act 57 of 1997 or as directed by members of the NLC.
6. Notification and publication of the winner
- 6.1The winner will be notified personally by telephone and by email within 7 (seven) days of the draw.
- 6.2The winner’s name (and, with the winner’s consent, a photograph) will be published on the Club’s website, the Club’s email newsletter distribution list, and the Club’s social media pages.
- 6.3Participants may obtain information regarding the outcome of the lottery from the lottery manager, at the Club’s offices, and via the Club’s website and other communication platforms referred to in clause 6.2.
7. Unclaimed prizes
- 7.1If the winner cannot be traced or does not respond within 30 (thirty) days of the draw, despite at least three documented attempts by the Club to make contact using the details supplied at the time of ticket purchase, a re-draw will be conducted from the remaining valid tickets under the same monitored conditions described in clause 5.2, alternatively the matter will be dealt with as directed by the NLC.
- 7.2The winner must complete and sign the Commission’s prescribed prize-winner declaration (form SL06/14) as a condition of receiving the prize.
8. Disclaimer of liability
- 8.1To the fullest extent permitted by law, the Club, its directors, officers, employees and volunteers, agents, and the suppliers of the prize (including any travel agent, tour operator, airline, hotel, visa facilitation agent, insurer or event organiser) shall not be liable for any loss, damage, injury, illness, death or other harm of any nature, whether direct, indirect, incidental, special or consequential, arising out of or in connection with:
- 8.1.1participation in this lottery, including the purchase, sale, use or possession of a ticket;
- 8.1.2the conduct of the draw or the determination, notification or announcement of the winner;
- 8.1.3the awarding, receipt, use, non-use or enjoyment of the prize or any component of it, including any visa application, whether granted or refused; or
- 8.1.4travel undertaken pursuant to the prize, including any delay, cancellation, rescheduling, denial of boarding or entry, visa refusal, loss of or damage to luggage or personal property, medical emergency, act of a third-party supplier, or any other event beyond the Club’s reasonable control.
- 8.1.5The grant of an entry visa remains at the sole discretion of the Irish immigration authorities. Neither the Club nor its appointed visa facilitation agent guarantees that a visa will be granted, and the Club shall not be liable if a visa application is refused, delayed or granted subject to conditions, provided the Club has facilitated the application and paid the associated fees in good faith.
- 8.2Without limiting the generality of clause 8.1, the winner and the winner’s nominated companion travel entirely at their own risk. The Club strongly recommends that the winner and companion satisfy themselves, in good time, as to passport, visa, health and other entry requirements for Ireland and any transit country before travelling.
- 8.3Nothing in this clause 8 excludes or limits any liability which may not lawfully be excluded or limited under the Consumer Protection Act 68 of 2008 or any other applicable law, including liability for death or personal injury caused by the gross negligence or wilful misconduct of the Club.
